TERMS AND CONDITIONS – HYDRAQUIP E-COMMERCE STORE
1. DEFINITION
- “Buyer” the person or organisation who buys or agrees to buy Goods from the Seller.
- “Seller” Hydraquip Hose & Hydraulics Ltd.
- “Terms and Conditions” this document and any special written conditions agreed by the Seller.
- “Order” the contract between the Seller and the Buyer for the sale and purchase of Goods.
- “Goods” the goods (or any part of them) set out in the Order.
- A reference to writing or written includes letter, EDI communication and email.
2. CONTRACT
- These Terms and Conditions govern all sales of Goods by the Seller.
- A legally binding contract is formed upon delivery of the Goods.
- All Orders are accepted subject to these Terms and Conditions only.
- These Terms and Conditions supersede all previous versionss
3. PRICES & PAYMENT
- Prices are those displayed on www.hydraquip.co.uk or as stated in formal quotations.
- Full payment authorisation is required before acceptance unless the Buyer holds an approved credit account.
- Account customers must pay invoices by the end of the month following the invoice date.
- Late payments may result in revoked credit and interest charges as per the Buyer’s credit agreement.
- The Buyer is responsible for all Orders placed by its authorised employees.
- Promotional pricing requires correct use of the relevant promotion code.
- Pricing errors are not binding; the Seller will notify the Buyer of the correct price.
- Goods sourced from third‑party suppliers may require revised pricing via formal Quotation.
- Prices are exclusive of VAT unless otherwise stated.
- Payment transactions are completed immediately prior to dispatch.
4. AVAILABILITY & DELIVERY
- The Seller endeavours to maintain sufficient stock. If insufficient stock exists, the Seller may substitute goods or issue a refund.
- Product colours/finishes may vary based on manufacturer supply.
- Title to the Goods remains with the Seller until paid for in full.
- Delivery will be made to the address specified by the Buyer.
- If the Buyer is unavailable, the courier may deliver to a neighbour or secure location.
- If all Goods are not received within 48–72 hours of the expected delivery date, the Buyer must notify the Seller immediately.
- Delivery timeframes are those advertised on the Seller’s website or communicated at the time of the order.
- If Goods become temporarily unavailable, the Seller will agree revised delivery arrangements with the Buyer.
- Installation should not be scheduled until Goods have been received and fully checked. The Seller cannot be subjected to late fees.
5. INTERNATIONAL ORDERS & SHIPMENTS
- Import duties and taxes for deliveries outside the UK are the Buyer’s responsibility.
- The Seller is not liable for duties/taxes applied by external authorities.
- Failure to pay duties/taxes may result in deductions from refunds or additional billing.
- Buyers returning Goods from outside the UK must return them to a valid UK address at their cost.
- Oversized or palletised international shipments may require updated shipping quotations.
6. RETURNS, EXCHANGES & CANCELLATIONS
A) CANCELLATIONS & DAMAGED GOODS
- The Buyer may cancel an Order if the order is not custom or bespoke made and the production of this has not yet been started.
- Damaged, faulty, or incorrectly supplied Goods must be communicated to the Seller within 10 days of delivery via phone, mail, or email.
- Refunds for faulty or incorrectly supplied Goods will be issued after inspection and confirmation by the Seller.
B) RETURNS OF CATALOGUE GOODS
Returns of standard catalogue Goods purchased through the Hydraquip Web Store are accepted only if all the following conditions are met:
- Goods are unused and sourced from the Hydraquip Web Store.
- Goods are in a resalable condition.
- Goods were invoiced within 10 days of the requested return date.
- Return carriage must be organised by the Buyer; Goods must be delivered within 2 days of a returns number being issued.
- A valid Hydraquip Returns Number must accompany the Goods.
- Items without a returns number will be moved to the Customer Collection Point.
- The Buyer must collect these within 7 days.
- Goods should be in original packaging where possible and include manuals/accessories.
- Single‑line returns valued under £10 will not be processed.
- Goods shipped outside the UK must first be returned to a valid UK address at the Buyer’s cost.
C) HANDLING CHARGES
Approved returns will incur:
- £10 return fee per order, and
- A 25% handling charge or £25, whichever is greater.
Goods must be securely packaged and addressed to:
Hydraquip Hose & Hydraulics Ltd (Delivery address will be advised once the return number has been issued)
The Seller is not responsible for Goods returned via Buyer‑organised carriers.
Under no circumstances should Goods be handed to a local Hydraquip representative.
D) NON RETURNABLE GOODS
Hydraquip cannot accept returns for:
- Goods specially sourced or manufactured for the Buyer
- Non‑catalogue items
Such items are non‑cancellable and non‑returnable, unless defective or incorrectly supplied.

7. LIABILITY
- If a problem is reported within 10 days, the Seller will:
- correct shortages or non‑delivery after an investigation to identify the issue and will then:
- repair or replace defective Goods, or
- refund the Buyer for affected Goods.
- The Seller’s liability is limited to the value of the Goods.
- The Seller is not responsible for installation or use of Goods by the Buyer or third parties.
- Trade customers indemnify the Seller against claims arising from improper installation or misuse.
8. FORCE MAJEURE
The Seller is not liable for failure or delay caused by circumstances beyond its control, including (but not limited to) natural disasters, war, strikes, lockouts, flooding, or supplier failures.
9. HEALTH & SAFETY
- The Buyer acknowledges responsibility for understanding and complying with relevant safety requirements.
- For age‑restricted Goods, the Buyer confirms that delivery will be accepted by a person aged 18 or over.
10. PROMOTIONS & DISCOUNTS
- Offers apply only to promotions on www.hydraquip.co.uk.
- Promotions do not apply to quotations, offline orders, or scheduled orders.
- Promotions are non‑transferable and cannot be exchanged for cash.
- Promotions cannot be used with other discounts.
- Refunds for promotional purchases reflect the discounted amount paid.
- Full Delivery & Returns policies apply.
- The Seller may amend or withdraw promotions at any time.
